Medical treatment decisions, care home choices, day-to-day care, life-sustaining treatment (a separate explicit choice). Only activates when the donor lacks capacity to make the specific decision in question.

The OPG offers fee remission and full exemption for some applicants. Apply when submitting the LPA — there's a separate form (LPA120A).

Capacity can't be backdated

Once capacity is lost, an LPA can no longer be made. The alternative is a court deputyship — slower, dearer, and supervised.

The cheapest, calmest version of this is the one set up while there is still time to choose.
Why it matters

Twenty weeks is the gap between needing one and having one.

An LPA only works once it is registered — and registration cannot start until capacity exists. These are the gaps it closes.

Bank lockout on capacity loss
Without a registered P&FA LPA, an attorney cannot operate sole-name accounts when the donor loses capacity. The bank's own attorney department becomes the bottleneck — Court of Protection deputyship typically takes 6–12 months and costs £400–£1,500.
Director compliance vacuum
Sole director without a P&FA LPA: corporate decisions freeze on incapacity. ECCTA reporting obligations continue regardless. Companies House does not wait.
Medical treatment limbo
Without H&W LPA, decisions about life-sustaining treatment, care home placement, and day-to-day care fall to clinicians using a best-interests test. An H&W LPA names who they consult.

Do I need a solicitor to make an LPA?
No — there is no legal requirement to use a solicitor. You can prepare and register an LPA yourself using the official GOV.UK service for just the £92-per-document registration fee.

People use a solicitor (typically £100–£250 per LPA, sometimes more) when their situation is complex, when they want the wording checked, or for peace of mind, because the forms have strict rules on certificate providers, witnesses and notification, and an Office of the Public Guardian rejection restarts the process.
What is the difference between the two types of LPA?
A Property & Financial Affairs LPA lets your attorney manage money, bank accounts, bills and property.

A Health & Welfare LPA lets them make decisions about medical care, where you live, and daily routine — but only once you can no longer make those decisions yourself. They are separate £92 registrations; many people register both.
Can I get the LPA fee reduced or waived?
Yes. If your gross annual income is under £12,000 you can apply for a 50% reduction (£46 per LPA).

If you receive certain means-tested benefits — such as Income Support, income-based ESA or Guarantee Pension Credit — you may be exempt from the fee entirely. You apply using form LPA120 and provide evidence.
How long does it take to register an LPA?
Allow about 8 to 10 weeks from posting to a registered LPA when there are no mistakes — that is the Office of the Public Guardian's published timescale, and it already includes the statutory 4-week notice period.

Any error on the form can cause a rejection, which restarts the clock — so it is worth checking the forms carefully before sending them.
What happens if I don't have an LPA and lose capacity?
Nobody automatically has the right to manage your affairs — not even a spouse.

Your family would have to apply to the Court of Protection to be appointed as a deputy, which is far slower and more expensive than an LPA (application fees, an assessment, and often ongoing supervision fees). Setting up LPAs in advance avoids that.
