§1What it means

Two LPAs, £184 in fees — and 8 to 10 weeks before either can be used.

A lasting power of attorney is a legal document appointing someone to make decisions on your behalf if you lose mental capacity.

There are two types: Property & Financial Affairs (bank accounts, investments, property) and Health & Welfare (medical treatment, care, daily wellbeing).

Each costs £92 to register with the Office of the Public Guardian.

The critical timing constraint: an LPA cannot be used until it is registered — and registration takes approximately 8 to 10 weeks.

Income-related remissions are available. Donors earning less than £12,000 a year pay half-fee (£46 per document).

Those on qualifying means-tested benefits (Income Support, income-based JSA, income-related ESA, Housing Benefit, or Pension Credit Guarantee) pay nothing.

Universal Credit no longer qualifies for the full exemption from 2 February 2026 — UC recipients should apply for the 50% reduction. Form LPA120A is used to claim a remission or exemption.

A 68-year-old registers both types of LPA for herself. No means-tested benefits, income above £12,000.

It costs £92 to register each lasting power of attorney with the Office of the Public Guardian (OPG).

If you register both a Property & Financial Affairs LPA and a Health & Welfare LPA, the total fee is £184.
Yes. If the donor has an annual income of less than £12,000, the fee is reduced by 50% to £46.

If the donor receives a qualifying means-tested benefit — Income Support, income-based JSA, income-related ESA, Housing Benefit, or the Guarantee Credit element of Pension Credit — the fee is waived entirely.

Universal Credit no longer qualifies for the full exemption from 2 February 2026; UC recipients should apply for the 50% reduction instead. Apply using form LPA120A.
The OPG currently states that registration takes approximately 8 to 10 weeks from the date a complete application is received, provided there are no errors in the application.

This is why acting early matters: an LPA cannot be used until it is registered, and if capacity is lost before registration is complete, it may be too late to make one.
A Property & Financial Affairs LPA gives attorneys authority over bank accounts, investments, property, and financial decisions.

A Health & Welfare LPA covers medical treatment, care arrangements, and day-to-day wellbeing decisions. The two are separate documents, each requiring its own registration fee.
Yes. LPAs can be made using the OPG's online service or paper forms (LP1F for property and financial affairs, LP1H for health and welfare).

A certificate provider — a professional such as a GP or solicitor, or an independent person who has known the donor for at least two years — must certify the donor has capacity and is not under pressure.
