A new child or dependent

The arrival of a child or a new dependent alters the household's obligations — but updates none of the instruments that carry them. A will drafted before the child was born rarely names a guardian.

What changes

Guardian appointments, trust provisions and distribution language may all be missing or misaligned. Life cover and pension nominations may not match the new dependency. A new adult dependent can add obligations that sit outside the estate plan entirely.

Records to locate
  • The current will — and whether it names a guardian and suitable trust provisions
  • Life-insurance cover and pension nominations against the new dependency
  • For an adult dependent: care contributions, financial support, and their own authority instruments
Authority to prove
  • Guardian appointment in the will for a minor child
  • Where a dependent adult may lose capacity: their LPA or deputyship position
Formal requirements
  • Guardian appointments are made through the will
  • Trust provisions may be needed so assets pass appropriately to a minor
Immediate actions
  • Confirm a guardian is named and willing
  • Review life cover and nominations for the new structure
  • Register the birth and update the household record
