A sudden absence or emergency

The most acute of the primary events, because it creates operational demand without triggering any settled legal category. The person may simply be unavailable — abroad, hospitalised, detained, unreachable.

What changes

Probate is not engaged and incapacity may not be established, so the authority routes are limited. Practical trust within the family is often not enough for institutions — they need an instrument.

Records to locate
  • A digital and physical access map — where things are and how to reach them
  • Accounts, recurring payments and the providers behind them
  • Emergency contacts and any short-term authority already in place
Authority to prove
  • A property & financial affairs LPA, if its terms allow acting while the donor retains capacity
  • An ordinary power of attorney covering a defined absence or transaction
  • Joint financial arrangements for shared household payments
Formal requirements
  • No probate (the person is alive) and no established incapacity — so substitute-authority routes are narrow
  • An ordinary PoA made in advance can cover a defined absence or period
Immediate actions
  • Confirm which authority route actually applies during the absence
  • Keep essential payments and obligations running
  • Reach the people and providers who need to know
